Ref: The Jackson Herald, April 10, 1913 BANKRUPT SALE In Re: Carr, Boyd & Company, David R. Marlow, Individually, bankrupt. Pursuant to an order passed by Honorable W. B. Sloan, a referee in bankruptcy for the United States District Court for the Northern District of Georgia, the undersigned, as trustee, will sell at Maysville, Georgia, on May 6, 1913, between eleven o’clock a.m. and four o’clock p.m., assets of David R. Marlow, consisting of the following described real estate located in Jackson County, Georgia: Parcel No. 1. One hundred and fifty (150) acres of land, more or less, lying and being in Miller’s District (455th) in Jackson County, Georgia, being the home place of D. R. Marlow, and adjoining lands of Mrs. Mamie Marlow on the east, S. L. Tolbert and C. M. Crook on south, W. A. Randolph on the west, and J. A. Ragan and R. B. Marlow on the north, and being the same property conveyed by D. R. Marlow and M. H. Hutchens, administrators Mrs. Ella Hutchens, to T. N. Highfill, and by T. N. Highfill to D. R. Marlow. Parcel No. 2. A certain tract or parcel of land situated, lying and being in Jackson County, Georgia, and in the 455th District, G. M., of said county, beginning at a stake corner on the road; thence north 57 east, 12 chains and 60 links to a black oak; thence north 85 feet, 17 chains and 80 links to a post oak; thence north 16 ˝ east, 15 chains and 50 links to a pine; thence south 18 chains and 10 links to a post oak corner on said road; thence along the road to the beginning corner; containing forty (40) acres, more or less, adjoining lands of Ed Beaty on the east, and lands of D. R. Marlow on the south, and being the land formerly owned by Elvira J. Wilson on the 15th day of March, 1890, recorded in Book W, page 662, April 11, 1890, and being the same property designated as “Tract Two” in a deed to H. D. Watkins from the British American Mortgage Company, Limited, dated the 29th day of December, 1908, bounded on the north by lands of J. M. Blackstock, east by lands of A. E. Beatie; south by Frank Wallace; being the same property conveyed to D. R. Marlow by H. D. Watkins by deed dated January 2, 1909, recorded in office of clerk of superior court Jackson County, Georgia, on January 5, 1909, in Book KK, page 86. Parcel No. 3. A certain tract or parcel of land lying and being in Jackson County, Georgia, and in Miller’s District of said county, containing ten (10) acres, more or less, adjoining lands of R. B. Marlow, Lee Marlow, Ple?s James, and estate Mrs. Hutchens; being the same property conveyed to D. R. Marlow by F. C. Wallace, guardian, by deed dated November 1, 1904, recorded in Book HH, page 195, in the office of the clerk of superior court of Jackson County, Georgia, on the 8th day of February, 1905. Subject to lease between W. F. Morris and H. A. Ferris, receivers of Carr, Boyd & Company, and D. R. Marlow, dated December 14, 1912, and ending December 31, 1913. This lease applies only to the parcels No.s 2 and 3. Terms of Sale: To be one-third (1/3) cash, payable on confirmation, balance in two equal installments on or before six months and twelve months from confirmation. All bids to be subject to acceptance or rejection by the court. Bids must be accompanied by certified check for 10 percent of bid.
