Know all men by these presents, that I, John M. Ariail of Jackson County, in said State, do hereby appoint W. H. Harrison of Fulton Co. my true and lawful attorney in fact, for me and in my name, to receive and receipt for whatever amount of money I may be entitled to from the State of Georgia be reason of the injury received as aforesaid in the military service of the Confederate States, as stated in the foregoing affidavit; hereby authorizing my said attorney to receipt in my name for any Warrant that may be issued by the Governor, or for any sum of money which may be coming to me for the reason aforesaid.

In witness whereof, I have hereunto set my hand and seal, this 28th day of May 1892.

For Use of Applicants Who Have Not Heretofore Drawn

State of Georgia, Jackson County

Personally appears John M. Ariail of Jackson County, State of Georgia, who, being duly sworn, says on oath that he is a bona fide citizen and resident of Georgia, and has been continuously since the first day of January, 1859; that he enlisted in the military service of the Confederate States during the war between the States, and served as a private in Company A of 2nd Regiment of Georgia Volunteers Bennings Brigade; that whilst engaged in such military service, at the battle of Gettysburg in the state of Pennsylvania on the 2nd day of July 1863, he was disabled as follows:  bombshell wound on the left arm and shoulder; said bombshell passing between said left arm and the body of deponent causing partial paralysis and permanent stiffness in said left arm and shoulder; said arm and shoulder having perished away, deponent cannot use his left arm; cannot open or shut his left hand; said left arm being rendered substantially and essentially useless for all purposes.

Deponent desires to participate in the benefits of the Act, approved October 24th, 1887, and the Acts amendatory thereof, and makes application for the allowance to which he is entitled for the year thereunder, ending October 26, 1892.

Affidavit for Witnesses

State of Georgia

County of Banks

Personally appeared before me, the undersigned Ordinary in and for said County, S. D. Wilbanks, John W. Brown and Charles C. Duncan each of whom, being duly sworn according to law, severally say, under oath, that they are personally well acquainted with John M. Ariail whose application is herewith presented for a pension, and that they served with him in the army, and from our personal knowledge he was injured by the service as follows:

On the 2nd day of July 1863 whilst charging a battery at Gettysburg, John M. Ariail was wounded by a bombshell passing between his left arm and his body; it tore his clothing from his left side and his left arm; it nocked him down; we did not see the shell; we heard it pass and saw John Ariail fall; we know that his left arm and his left side was badly bruised; he never was able to bear arms after he was wounded; his left elbow and shoulder joints became stiff and has remained so up to the present; he cannot open nor shut his hand; he got a furlow; went home; when his furlow was out he returned to his company; was not able to use his gun with his left arm; he assisted in waiting on the wounded at the field hospital in time of battle till the close of the war; he never asked for a discharge that we no of; each of us were present at Gettysburg when John M. Ariail was wounded; since the close of the war he has lived on his farm doing such work as he can do with his right hand—his left arm being permanently and totally disabled; each of us have known John M. Ariail ever since 1860 up to the present; his left arm was sound before he was wounded so far as we no; never herd any complaint of his arm before he was wounded; John M. Ariail is now not able to do manual or other labor with his left arm.

We personally know above stated facts.  We were with him in the army and have known him ever since.  Applicant is permanently disabled as stated and has been so to our certain knowledge ever since 1863.  We have no interest in the recovery of a pension by him.

Physician’s Affidavit

State of Georgia, Jackson County

Personally comes before me, H. W. Bell, Ordinary of said County, S. J. Smith and W. J. Hood, both known to me as reputable physicians of said County, who being severally sworn, say on oath that they have carefully examined John M. Ariail and after such personal examination, say that the applicant has been injured as follows:

Partial paralysis of the left arm and stiffness of the elbow and shoulder joints.  He cannot open or shut the hand.  He states that this (illegible word) was caused by a shell passing between the left arm and thorax.  There is no scar.  He cannot raise his arm to a level with the body.  There is total and permanent disability of the left arm which he believes was caused by the shell passing so stated above.

We have treated applicant professionally for (blank) years.

I, H. W. Bell, Ordinary of said County, do certify that I am well acquainted with J. M. Ariail, the applicant in the foregoing affidavit, and am well satisfied that the statements made by him in his said affidavit are true, and he is disabled, as he claims, and I know he is the individual he represents himself to be, and that he resides in this County.  I also certify that the foregoing witnesses are persons of respectability, and that their statements are worthy of full credit and belief.

John M. Ariail application for pension

The physicians who have examined the applicant, S. J. Smith and W. J. Hood, are asked following questions:

  1. State the extent of the paralysis of the arm (“partial” means anything less than total and may apply to very great or very little loss of movement or sensibility).
  2. As physicians and surgeons do you say under oath that the injury to applicant’s arm could have been caused by a ball or bomb passing by it, which did not hit the arm or leave any scar?  If so, explain how it could do so.
  3. Can applicant move the arm?  Is the elbow stiff?  Is the wrist stiff?  Is the shoulder stiff?  Is there any diseased bone?  And contraction of the muscles?  If so, explain effect of the contraction.
  4. How long have you known Mr. Ariail?  How long have you treated his arm if at all?
  5. Explain precisely what use he has of the crippled arm.

Answers to questions on opposite (previous) page.

  1. Partial paralysis of the left arm (motor and sensory) with stiffness of the shoulder.  Elbow and wrist joints with some contractions of the muscles, so that he cannot raise the arm to a right angle with the body, cannot bend the elbow to a right angle and cannot grasp anything with the hand.  There is very little sensibility in the arm.
  2. We cannot say whether the shell passing between the arm and the body caused the paralysis in this case, but suppose such a thing is possible from shock to the nerves.
  3. There is no diseased bone.  Balance of questions answered in no.1.
  4. Never met Mr. Ariail until the day the examination was made. Have never treated him.
  5. He cannot use the arm except raise it a little from the body and work the fingers a little but cannot grasp or hold anything in the hand.
